BIKE RENTAL REGULATION

The company CHRONO by Cognigni Giacomo is the owner of a rental business located at Via Fratelli Rosselli 151, Porto San Giorgio (FM). Renting and using a bicycle implies the renter's unconditional knowledge and acceptance of this contract, the rates, and the opening and closing times. The following terms are agreed upon and stipulated:

  1. 1. The renter declares to have inspected the bicycle and found it suitable for use, committing to return it in the same condition.

  3. 2. To rent a bicycle, the renter must present a valid identification document and a non-rechargeable credit card to Chrono Bike; these documents will be held by the manager until the end of the rental period.

  5. 3. The renter may use the bicycle only on paved roads and/or suitable routes for two-wheel travel according to the vehicle.

  6.  


  7. 4. The use of the bicycle requires the physical fitness and technical skill of the user. Therefore, by renting the bicycle, the user declares to possess adequate capability and appropriate competence without any reservations.

  9. 5. In the case of use by minors, by signing this contract, the parent/guardian or custodian assumes all responsibilities indicated in this contract and the civil code, and consequently authorizes the minor to use the bicycle under the conditions stipulated in this regulation.

  11. 6. The bicycle is to be used exclusively as a means of transport and treated with care, common sense, and diligence to avoid damage to the bicycle and its accessories. It is forbidden to use the bicycle for commercial activities or to lend it to others.

  13. 7. From the moment of delivery, the renter is the custodian and responsible for the bicycle until its return to the Manager; they are also responsible for any damage caused to themselves, the bicycle, third parties, and property during its use. No compensation can be requested from the Manager.

  15. 8. In case of theft or loss of the bicycle, the user must compensate the Manager for the amount specified at the current bike value* point on page 1 of the contract. The user must also provide the Manager with a copy of the report filed with the competent authorities and pay the amount equal to the value of the stolen bicycle (see Art.8), which will be refunded in case of recovery or return of the vehicle.

  17. 9. The renter will inspect the bicycle upon its return, and if any damage to the frame and/or mechanical parts and/or accessories is found, they will be considered the exclusive responsibility of the renter.

  19. 10. In case of loss of bicycle accessories or damage, the renter will require the customer to pay the amount necessary to restore the bicycle to its original condition, based on the price list below or, for items not listed, based on the supplier's estimate.

  1. 11. In the cases mentioned in points 7, 8, 9, the renter has the right to withhold the necessary amounts for repairs and/or replacements of damaged parts based on the price list indicated in this contract and, in case of theft or loss, to fully compensate for the bicycle's value as specified at the current bike value* point. For this purpose, the renter provides the manager with their non-rechargeable credit card details as a guarantee, authorizing the manager to withdraw the necessary amounts.

  3. 12. During the rental period, the user is not covered by any form of insurance, nor is the bicycle covered by liability insurance. The renter disclaims all responsibility for damages to the renter and/or third parties resulting from improper use of the bicycle and/or failure to comply with traffic regulations.

  5. 13. The Manager can conduct checks on users during bicycle use and may request its return if improper use is observed. The Manager may refuse to rent to individuals under the influence of alcohol or drugs (in accordance with articles 186-187 of the Highway Code) and for other reasons at the Manager's discretion.

  7. 14. The bicycle must be returned, respecting the hours indicated in this contract, to the same location where it was picked up. The bicycle is considered returned only if it is directly handed to Chrono Bike with a return signature on the contract; parking the bicycle outside the rental point during closing hours is not considered a return. Failure to return the bicycle without prior notice or not justified by exceptional circumstances will be considered theft and reported to the Judicial Authority.

  9. 15. The user may request the Manager to retrieve the bicycle, the cost of which is indicated in the contract; the Manager is not obligated to intervene, and failure to intervene cannot be a cause for contractual non-compliance. It is in the Manager's interest to retrieve the bicycle, and only temporary contingencies may make it impossible.

  11. 16. The rental price is agreed upon and accepted at the time of signing this contract, which serves as a receipt.

  13. 17. For matters not provided for in this contract, reference is made to the applicable legal provisions.


For issues not mentioned in this regulation, the relationship between the Parties (contracting parties) is governed by the civil code. For any disputes arising between the Parties, the competent court is Fermo.
